These Terms of Service govern your use of the Omnisartifex website and your purchase of artworks and related products through our online store.

By accessing our website, placing an order, or purchasing from us, you agree to be bound by these Terms of Service.

If you do not agree with these terms, please do not use our website or place an order.

1. About Omnisartifex

Omnisartifex is an art business offering original artworks, printed artworks, framed artworks, and other art-related products.

Throughout these Terms of Service, “we”, “us”, “our”, and “Omnisartifex” refer to the Omnisartifex business.

“You” and “your” refer to the person accessing our website or purchasing our products.

2. Eligibility

By using this website or placing an order, you confirm that:

  • You are legally capable of entering into a binding agreement;
  • The information you provide is accurate and complete;
  • You will use the website for lawful purposes; and
  • You will not use the website in a way that violates applicable laws or the rights of others.

3. Products and Artwork

We make every reasonable effort to ensure that artwork descriptions, photographs, dimensions, colours, and product information displayed on our website are accurate.

However, artwork is a physical and visual product, and minor variations may occur.

Differences may result from:

  • Screen and monitor settings;
  • Lighting and photography;
  • Printing processes;
  • Natural characteristics of canvas, paper, glass, paint, charcoal, ink, or other materials;
  • Hand-finishing or artistic processes.

Such minor variations do not necessarily constitute a defect.

Where an artwork is an original or handmade piece, natural variations and unique marks are part of its character.

4. Artwork Availability

Some artworks may be available in limited quantities, while others may be produced after an order is placed.

We reserve the right to limit quantities available for purchase.

If an item becomes unavailable after an order has been placed and we cannot fulfil the order, we will contact you and provide an appropriate resolution, which may include a refund.

5. Prices

All prices displayed on our website are stated in South African Rand (ZAR), unless otherwise indicated.

We reserve the right to change product prices at any time.

A price change will not affect an order that has already been accepted and paid for, except where required by applicable law.

We make reasonable efforts to ensure that prices are displayed accurately. If a significant pricing error occurs, we may contact you before fulfilling the order to confirm whether you wish to proceed at the correct price.

6. Orders

When you place an order through our website, you are making an offer to purchase the selected product.

After placing an order, you may receive an order confirmation by email. An order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been accepted or that the product is available.

We reserve the right to cancel or refuse an order in reasonable circumstances, including where:

  • A product is unavailable;
  • There is an obvious pricing or product-description error;
  • Payment cannot be successfully processed;
  • We suspect fraudulent or unauthorised activity; or
  • We are unable to fulfil the order for circumstances beyond our reasonable control.

If we cancel an order after payment has been received, we will arrange an appropriate refund.

7. Payment

Payment must be successfully received before an order is processed or production begins, unless otherwise agreed in writing.

Payments may be processed through third-party payment providers.

You agree to provide accurate and complete payment and billing information.

We are not responsible for delays caused by payment providers, banks, or other financial institutions.

8. Custom and Made-to-Order Artwork

Certain artworks may be created, printed, framed, or otherwise prepared specifically after you place an order.

For custom or personalised artwork, you are responsible for ensuring that all information, specifications, images, names, dimensions, and other details provided to us are accurate.

Once production has commenced, changes or cancellations may not be possible.

Custom and personalised artworks may not be eligible for cancellation, return, or refund due to change of mind, subject to applicable consumer law and our Return & Refund Policy.

9. Intellectual Property

All artwork displayed on the Omnisartifex website, including but not limited to:

  • Original artwork;
  • Digital artwork;
  • Illustrations;
  • Photographs;
  • Product images;
  • Videos;
  • Logos;
  • Brand names;
  • Website graphics;
  • Written content; and
  • Other creative material

is owned by or licensed to Omnisartifex unless otherwise stated.

You may not reproduce, copy, distribute, modify, sell, publish, commercially exploit, or create derivative works from our artwork or website content without our prior written permission.

Purchasing an artwork does not automatically transfer copyright or other intellectual-property rights to the purchaser.

Unless expressly agreed otherwise in writing, Omnisartifex retains the intellectual-property rights associated with the artwork.

10. Use of Artwork Images

You may not reproduce or commercially use photographs or digital representations of Omnisartifex artworks without permission.

This includes using our artwork or images to:

  • Manufacture additional products;
  • Sell reproductions;
  • Create merchandise;
  • Use in advertising;
  • Create NFTs or other digital assets;
  • Represent the artwork as your own;
  • Train or develop commercial creative datasets; or
  • Otherwise commercially exploit the artwork.

Personal, non-commercial sharing of our publicly available social-media content is permitted where appropriate attribution is maintained and the content is not altered or misrepresented.

11. Customer-Submitted Content

If you voluntarily submit photographs, reviews, testimonials, comments, or other content to Omnisartifex, you confirm that you have the necessary rights to provide that content.

By submitting content to us, you grant Omnisartifex permission to use, reproduce, display, and publish that content for legitimate business and marketing purposes, subject to applicable law.

Where appropriate, we may request separate permission before using identifiable customer photographs or testimonials in promotional materials.

12. Website Use

You agree not to:

  • Use the website for unlawful purposes;
  • Attempt to gain unauthorised access to our systems;
  • Interfere with website security or functionality;
  • Introduce malicious software or harmful code;
  • Scrape, copy, or systematically reproduce website content without permission;

Once an order has been dispatched, delivery is handled by the relevant courier or shipping provider.

We generally do not accept returns for change of mind, subject to any rights provided to consumers under applicable law.

If an artwork arrives damaged, defective, incorrect, or materially different from what was ordered, please contact us as soon as possible.

We make reasonable efforts to keep the information on our website accurate and up to date.

However, we do not guarantee that:

  • The website will always be available;
  • The website will always be error-free;
  • Product information will never contain inaccuracies; or
  • The website will be completely free from technical problems or interruptions.

Nothing in these Terms of Service excludes any consumer rights, warranties, guarantees, or protections that cannot lawfully be excluded under applicable law.
